CMGT 445 - Heavy Civil Contract Law


Description:
Construction contracts, liability, bonding, arbitration, and heavy civil highway specifications. CMGT 444 and CMGT 445 are equivalent courses; students may not receive credit for both. Permission of instructor.

Prerequisites:
Prerequisites: a Gen Ed K1- Academic Writing II course and BUS 241 and (CMGT 346 or CMGT 347).

Learner Outcomes:
Upon successful completion of this course, the student will be able to:

  • Understand the legal implications of contracts, common, and regulatory law to manage construction projects. Students will be able to understand the importance and nuances involved in construction contract language. Then apply critical thinking and express a contract position based on principles of construction contract law, both orally and in writing. ACCE SLO #17
  • Understand different methods of project delivery and the roles and responsibilities of all constituencies involved in the design and construction process. Understand the basic contract law behind the formation of a contract particularly as applied to construction.  Students will be able to apply this knowledge to fundamental principles used in construction. Then distinguish between different types of contract delivery methods (design-bid-build, design-build, etc.) along with payment types and understand the advantages and disadvantages of the various options. Students will know the potential duties and responsibilities of the constituencies involved in the development of the construction contract. ACCE SLO #12
  • Understand, work with and apply important construction contract clauses related to “changes”, “differing site conditions”, safety, matters of time, construction safety, ethics, environmental compliance,  changes, liquidated damages, constructive and directed acceleration, critical and non-critical delays, importance of scheduling and extended overhead related to contractual issues. 
  • Distinguish what constitutes a claim, how to quantify it in terms of time and money by applying tools of cost, apply guides to avoid and/ or resolve claims through the understanding of typical construction documents and the importance of maintaining extensive documentation to support and avoid claims.
  • Analyze professional decisions based on ethical principles. ACCE SLO #6
  • Understand the need for and identify bid, payment, and performance bonds. Know the reasons behind and responsibilities for liens, the Miller act and use of sureties. Understand owners and contractors’ rights and responsibilities when applying warranty clauses. Be able to differentiate between the different types and apply knowledge to obtain the appropriate insurance.
